The War on Drugs - Buffalo Style

Catherine Donohoe is a lucky person.  She is the owner of Thomas Hughies Tavern at 577 Ontario Street.  She was recently arrested and charged with felony drug charges by Buffalo Police Officers.  Her attorney presented a video tape to the Court showing that the Buffalo Police officers had planted the package of drugs behind her bar prior to arresting her.  Luckily, she had a video surveillance system running in her tavern.

The DA agreed to an adjournment in contemplation of dismissal, a process that normally takes at least 6 months before the charges are completely removed.  City Court Judge James A.W. McLeod consented to the ACD and made it effective that same day.  McLeod also called for an investigation of the police officers.

The police committed a heinous act.  Donohoe could have had her life ruined by their actions.  Not only would she have faced prison time, but her business could have been subject to seizure under the draconian drug laws.  She would have been a felon for life which would have severely limited her opportunities to future meaningful employment.  I hope the investigation of the police officers involved does not get brushed under the rug and that they are subject to the full force of the law.  The law they corrupted and tried to use to ruin a human life.  I can only wonder if this wasn’t a result of the much ballyhooed crackdown against quality of life crimes.

I wish this was a joke, but it isn’t.  It is sad reflection on the voters of New York State that Alan Hevesi was re-elected as State Comptroller, despite the strong allegations of misappropriating funds.  Twice, Hevesi has been caught using public money to pay for a chauffeur for his wife.  Once in New York City and again with New York State.

Hevesi could have done the honorable thing and withdrawn from the election.  Now he is apparently trying to strike a deal with the Albany County DA.  Hevesi will resign in return for no criminal charges lodged against him.

The whole ordeal is turning into a game of machine politics with the democrats trying to figure out how to play the game to their best advantage.  Spitzer has been very quiet, claiming to defer to Pataki as he is the Governor until January 1.  It seems to me that on “Day 1″ Mr. Right or Wrong should have had a clear opinion on resolving the Hevesi mess.  I’m sure that whatever Spitzer’s wishes are, they have been communicated to the Albany County DA, David Soares, who is also a democrat.

Pataki claims to be waiting for further results from a federal prosecutor.  Joe Bruno, Senate Majority Leader, says there is nothing he can do until Pataki makes a move.  YIKES, nobody wants to do anything.  Meanwhile, Hevesi has been hiding out with his head under a blanket hoping the storm will blow over.  He’s counting on the winds of re-election to sweep the scandal away.

Apparently Rick Snowden found the fox and his hunt for a new residence is over.  He settled with the New York State Tax Department and is paying $49,700, not the $600,000 the state originally sought.

Snowden will keep his 3 gentlemen’s clubs as well as his residence on Nottingham Terrace.  He is leaving open the possibility of running for public office.  The Country Executive position is frequently mentioned as a possibility.
